Intelligent Overseas Education New Update: New immigrants who applied for the latest essential worker and graduate pathway to permanent residence can now obtain an open work permit. Simultaneously, they await the outcome of their application.

Immigration Minister Marco Mendicino announced a new option besides crucial workers and international student grads in Canada: an open work permit.

New immigrants who applied for the newly launched pathway to permanent residence will be eligible for an open work permit beginning July 26.

This states that the temporary status expiration will not impact individuals who applied for the new programs. They might apply for a new work permit if their present job or study permit expires before the commencement or denial of their application by Immigration, Refugees, and Citizenship Canada (IRCC).

Without this new open work permit, applicants risk being forced to leave Canada, even though they have already filed for a program designed to assist them in remaining in Canada. This policy’s work permits will be valid until December 31, 2022.

“Our new pathway to permanent residence for 90,000 critical employees and overseas graduates is a significant step forward—unprecedented in its size, speed, and scope,” Mendicino stated in a news release. “This new open work permit enables people who have been vital to the pandemic’s success to continue their exceptional service.”

While specific other existing options exist to assist individuals in remaining in Canada, the new policy will fill some gaps. International student graduates, for example, can apply for a new Post-Graduate Work Permit (PGWP) under the government’s interim policy announced in January. This opportunity, however, will end by July 27. The new paths accept applications through November 5, and there is still plenty of space in most of the programs for contemporary scholars. Only the International Graduates stream is complete at the moment.

How to obtain a fresh open work permit

Applicants must demonstrate the following to be qualified for this one-time open work permit:

  • have applied for permanent residency through one of the new channels;
  • obtained a valid work permit at the time of their application;
  • obtain a work permit that will expire in the following four months;
  • hold temporary resident status, have maintained position, or are eligible to regain status at the time their applications for an open work permit is presented;
  • are physically present in Canada at the time their application for an open work visa is presented;
  • held any occupation at the time their application for permanent residency was filed; and
  • When their application was filed, they met the language requirements for the stream to which they applied.

Spouses or common-law partners of the applicant and dependent children over the age of 18 are also eligible for the open work visa, providing they are also in Canada. Additionally, if you applied to extend your work permit before the expiration of your present one, you may be allowed to preserve your position; this would allow you to work without a license under the same terms as your initial permission while IRCC issues a replacement permit. On July 26, 2021, IRCC’s website will provide further information on applying online for the new open work permit.
